Settlement Overview

This class action settlement resolves allegations that Mid America Pet Food sold dog and cat foods contaminated with Salmonella. Between 2023 and 2024 (following recalls beginning September 2023), multiple brands produced by Mid America including Victor, Wayne Feeds, Eagle Mountain, and certain Member’s Mark foods were voluntarily recalled after testing positive for Salmonella at the production facility. The recall and subsequent lawsuit claim the contaminated food posed serious health risks to pets (and humans handling the food), including illness or death for animals and possible infection for people. Under the settlement, Mid America Pet Food has agreed to a $5.5 million settlement fund to compensate eligible purchasers and pet owners. Eligible class members may submit claims for: • Food Purchase Claims for people who bought recalled pet food. • Pet Injury / Pet Death Claims for pets who became ill or died after consuming recalled food. Depending on documentation (receipts, vet records, etc.) or lack thereof, claimants may receive either full reimbursement or a limited flat-rate payment. The settlement covers pet food bought nationwide, not just in limited states. The affected products include dry dog and cat foods sold under Victor, Wayne Feeds, Eagle Mountain, and Member’s Mark brand names with recalled lot/best-by dates. In exchange for payments, class members who do not opt out release Mid America from further claims related to these recalls. The settlement does not require admission of wrongdoing by Mid America.

Who Is Eligible?

You qualify if: • You purchased one or more covered Mid America pet food products in the U.S. during the class period of the recall. • For pet-injury or pet-death claims: your pet consumed the recalled food and suffered illness or death. • You are not excluded as a reseller, prior individual settlement recipient, or certain insiders/officers. • You submit a valid claim form by the deadline. Covered pet food products include (but are not limited to): • Victor brand dry dog or cat food from the recalled lots. • Wayne Feeds brand dog or cat food from recalled production. • Eagle Mountain pet food products distributed under the recall. • Member’s Mark pet food varieties (as listed on the official recall list), including certain dry foods with “best by” dates before October 31, 2024. You should review the official “covered products” list on the settlement site to confirm whether your specific bag(s) qualify.

How to File a Claim

1. Obtain and complete the official Claim Form (online or by mail) on the settlement website. 2. For food purchase claims: provide receipt or proof of purchase if available; or submit the “undocumented claim” form for up to two bags. 3. For pet-injury / pet-death claims: provide veterinary records or documentation if available; or submit a valid declaration if no documentation exists. 4. Submit the claim before the deadline: February 5, 2026. 5. Only one claim form per household for food-purchase or pet-injury/pet-death is allowed.

Documentation Requirements

• With proof: Receipts, invoices, order confirmations, vet bills, or other relevant purchase/treatment records will support claims for full reimbursement or documented injury losses. • Without proof: Undocumented food-purchase claims are capped at $20 per bag, with a maximum of 2 bags per claimant (i.e. max $40). • For undocumented pet illness/death claims: $50 for illness, $100 for death (based on claimant declaration). • All claims: documented or undocumented are subject to possible pro-rata reduction, depending on total approved claims vs. available fund.

Payout Details

• Documented Food Purchase Claims: 100% reimbursement of purchase price of recalled food. • Undocumented Food Purchase Claims: $20 per bag, up to 2 bags (max $40). • Documented Pet Injury / Pet Death Claims: 100% of approved vet/medical losses, up to $100,000 per valid claim form. • Undocumented Pet Illness/Death Claims: $50 for illness, $100 for death (if no documentation). • Payments may be adjusted pro-rata if total claims exceed the fund.
