Settlement Overview

The FCDG Data Settlement resolves a class action lawsuit (Kelly Gorder, et al. v. FCDG Management, LLC d/b/a First Choice Dental) concerning a cybersecurity data breach disclosed in October 2023. Plaintiffs alleged First Choice Dental failed to implement reasonable security safeguards, resulting in a data incident that potentially exposed individuals’ names, dates of birth, Social Security numbers, driver’s license numbers, financial account numbers, health information, and other sensitive data. First Choice Dental denies liability but agreed to settle to provide relief to affected individuals and improve future data security practices. 


Under the settlement, affected individuals across the United States may file timely claims to recover documented economic losses or opt for an alternative cash payment, along with optional credit monitoring services. The settlement also includes provisions for enhanced cybersecurity measures.

Who Is Eligible?

You may be eligible if:

  • You are an individual in the United States whose private information was implicated in the data incident discovered by First Choice Dental in October 2023
  • You received a Settlement Notice or confirmed with the Administrator that your data was affected. 
  • You submit a valid Claim Form by the claim deadline

Excluded are the defendant, affiliates, judges and their families, and individuals responsible for the breach.

How to File a Claim

  1. Visit the official claim filing page on the settlement site. 
  2. Use your Unique ID provided on the mailed Notice to start your claim online. If you didn’t receive a Unique ID but believe you are a class member, contact the Settlement Administrator to obtain it. 
  3. Select whether you’re claiming Documented Economic Losses or the Alternative Cash Payment.
  4. Upload documentation if seeking reimbursement for documented losses.
  5. Complete and submit the Claim Form online or mail it postmarked by the deadline. 

Tip: Keep copies of all submissions and any supporting documents for your records.

Documentation Requirements

  • Receipts or records showing unreimbursed out-of-pocket expenses directly caused by the breach.
  • Examples: identity theft losses, credit repair fees, attorney or accountant fees, costs for freezing/unfreezing credit, monitoring fees, notary/postage expenses.

Payout Details

  • Documented Economic Losses: Up to $6,000 per person for unreimbursed, verifiable expenses related to the breach. 
  • Alternative Cash Payment: Flat $50 payment without documentation. 
  • Credit Monitoring: Up to three years of CyEx Medical Shield monitoring, including $1,000,000 identity theft insurance, available with any claim. 

Payments may be prorated downward if necessary to stay within the $1,225,000 settlement cap.
