Settlement Overview

This settlement resolves claims that Evenflo misled purchasers by labeling and advertising its “Big Kid” belt-positioning booster seats as “side-impact tested” and safe for children weighing 30 pounds or more. According to the plaintiffs, those marketing claims gave parents a false sense of safety. Evenflo denies wrongdoing but agreed to settle for $3.5 million to avoid further litigation. Under the settlement, eligible class members may submit claims for up to two Big Kid booster seats. For each seat claimed, they may receive a pro-rata cash payment from the net settlement fund plus a $25 Evenflo credit that can be used toward future Evenflo product purchases through Evenflo.com. In addition, Evenflo will provide enhanced safety disclosures, include clearer information about minimum weight recommendations, and post an educational video on transitioning children into boosters.

Who Is Eligible?

• You must have purchased an Evenflo “Big Kid” booster seat in the U.S., DC, or U.S. territories. • The purchase date must be between January 1, 2008 and December 31, 2022. • You may submit claims for up to 2 seats per person.

How to File a Claim

1. Go to the settlement website and choose to claim online or print the claim form. 2. If you received a notice, use the Unique ID and PIN provided. 3. If you didn’t receive a Unique ID, complete the claim form with your purchase information (retailer, purchase date, city/state, seat color/pattern) or provide proof. 4. Sign and date the claim form. 5. Submit the form by mail (postmark by November 24, 2025) or online.

Documentation Requirements

• If you have a Unique ID from a mailed/email notice, you do not need to submit proof of purchase. • If you do not have a Unique ID, you must provide documentation such as: - A purchase receipt, invoice, or credit card statement showing the booster seat purchase. - Or documentation showing retail rewards submission. - Or a photo of the booster seat or its packaging, plus purchase details (city, state, year, retailer, seat pattern). • Your claim form must be complete, signed, and truthful.

Payout Details

There is a $3.5 million settlement fund. • Cash payouts will be pro rata, based on the number of valid seat claims submitted. • In addition to the cash, for each seat claimed (up to 2), you get a $25 Evenflo credit to spend on Evenflo.com. • Payment options may include eGift card, Venmo, Zelle, Virtual Mastercard, or check.
