Plaintiffs allege the released fuel landed on residential properties, vehicles, outdoor areas, parks, and schools, creating environmental hazards, property damage, and public safety concerns. Delta denies wrongdoing, arguing its crew followed aviation safety protocols, but agreed to settle to avoid costly and uncertain litigation.
The settlement creates a $78.75 million fund to compensate qualifying property owners, residents, and renters whose homes or rented dwellings (1-4 unit residential properties) were located within the certified class area on January 14, 2020. Verification is based on expert mapping and the official list of affected residences prepared by an expert. After court-approved deductions (notice and administration costs, attorneys’ fees, and service awards), the remainder (approximately $50.59 million) will be divided into two funds: an Owners’ Settlement Fund (67%) and a Residents’ Settlement Fund (33%). Payments are distributed equally among verified claimants within each group.
Class members must submit valid claim forms by the deadline to be eligible for compensation. Payment amounts are not yet fixed and will depend on the number of verified claims submitted. Claims can be filed online or via mail with required documentation.
